B/S/C Terms of Sale & Site Use

1. Scope

These Terms of Sale & Site Use apply to bscrew.io, B/S/C legal pages, product pages, acquire requests, cart and checkout flows, order communications, and any purchase or attempted purchase from B/S/C.

B/S/C operates from Los Angeles, California. B/S/C presents and sells art, garment objects, limited products, one-of-one works, image systems, apparel, and related items through a curated request-based acquisition process.

By accessing the site, submitting a request, communicating with B/S/C, using checkout, approving payment, or purchasing from B/S/C, you agree to these Terms.

2. Request-Based Acquisition

B/S/C is not a standard instant-purchase storefront.

Submitting an acquire request, art request, contact form, cart action, or similar inquiry does not create a purchase, hold, reservation, contract, or obligation by B/S/C to sell an item.

A sale is confirmed only after B/S/C confirms availability, item details, condition, price, taxes, shipping, duties, payment terms, and final order details.

B/S/C may accept, decline, cancel, limit, or refuse any request or order at its discretion, including where an item is unavailable, incorrectly listed, incorrectly priced, suspected of fraud, subject to shipping restrictions, subject to payment or legal restrictions, or otherwise unsuitable for sale.

3. Nature of B/S/C Works and Products

B/S/C items may include art objects, garment objects, limited products, one-of-one works, handmade or modified garments, experimental materials, archival pieces, studio objects, image-based works, apparel, and other limited items.

These items may not behave like mass-produced retail goods. Variations in material, finish, construction, distressing, aging, marks, irregularity, sizing, proportion, color, texture, or surface may be part of the intended character of the work or product.

Unless B/S/C expressly confirms otherwise in writing, those characteristics are not defects.

Product images, screen displays, lighting, device settings, compression, and photographic conditions may affect how an item appears online. B/S/C does not guarantee that product images will exactly match the item as viewed in person, on another display, or under different lighting.

4. Product Information and Availability

B/S/C attempts to describe items accurately, including images, titles, dimensions, condition notes, material notes, availability, and price where applicable.

Availability is not guaranteed until B/S/C confirms the sale. Items may be withdrawn, reserved, sold, modified, archived, or made unavailable at any time.

B/S/C may correct errors, inaccuracies, omissions, pricing mistakes, inventory mistakes, or availability mistakes at any time, including after a request is submitted or an order is placed.

5. Pricing, Taxes, Duties, and Fees

Prices may be listed on the site or confirmed by B/S/C during the acquisition process.

Mandatory item prices will be presented before a sale is confirmed. Taxes, reasonable shipping charges, duties, customs charges, import fees, brokerage fees, insurance charges, and other destination-specific or transaction-specific costs may be calculated or confirmed separately where permitted by law.

International buyers and buyers outside California may be responsible for duties, customs charges, import taxes, brokerage fees, local taxes, and other destination charges unless B/S/C confirms otherwise in writing.

B/S/C will not falsify customs values, product descriptions, origin information, or shipment documents.

6. Payment and Order Confirmation

Payment may be processed through Shopify, Shopify-supported payment providers, or another payment method approved by B/S/C.

An order is not final until payment is accepted and B/S/C confirms the order.

B/S/C may cancel or refuse an order before shipment where fraud, error, payment failure, inventory issue, shipping issue, legal restriction, customs restriction, payment-provider issue, or another material issue is identified.

If B/S/C cancels a paid order before shipment, B/S/C will provide an appropriate refund for the unshipped item, except where another resolution is required by law or agreed in writing.

7. Final Sale

All confirmed sales are final except where required by law or where B/S/C approves a remedy for a damaged, defective, wrong, or materially incorrect item.

Returns, refunds, exchanges, or cancellations are not accepted for change of mind, buyer's remorse, fit preference, sizing preference, styling preference, delayed decision, material preference, color preference caused by screen or lighting differences, failure to read product information, or any other reason not approved by B/S/C in writing.

This final sale policy is a material condition of the B/S/C acquisition process.

8. Damaged, Defective, Wrong, or Materially Incorrect Items

If an item arrives damaged, defective, wrong, or materially different from the confirmed description, contact B/S/C within 48 hours of delivery at hello@bscrew.io.

Include your order number or request reference, name, contact email, a description of the issue, clear photographs of the item, clear photographs of all packaging, and photographs of any visible shipping damage.

You must keep the item, packaging, labels, shipping materials, documentation, accessories, and included materials until B/S/C completes review.

Do not return any item without written authorization from B/S/C.

If B/S/C determines that an item was damaged, defective, wrong, or materially different from the confirmed description, B/S/C may offer one or more remedies depending on the circumstances and applicable law, including repair, replacement if available, store credit, partial refund, refund, shipping claim assistance, or another appropriate resolution.

9. Shipping and Delivery

Shipping details may be displayed at checkout or confirmed separately by B/S/C.

For high-value, fragile, limited, custom, one-of-one, archive, or garment-object items, shipping may require additional confirmation, special handling, insurance, signature confirmation, restricted carrier service, customs review, or additional preparation time.

Delivery dates and shipping estimates are estimates unless B/S/C expressly confirms a specific shipment or delivery commitment in writing.

If shipment is delayed beyond a confirmed timeframe, B/S/C may contact you with an updated estimate, request confirmation to continue with the delayed shipment, offer another available resolution, or provide a refund for the unshipped item where required by law.

Risk of loss may transfer according to the applicable shipping terms, carrier rules, insurance terms, and order details. If there is a delivery problem, contact B/S/C promptly.

10. International Orders

B/S/C may ship internationally where postal or shipping services deliver, subject to carrier, customs, legal, insurance, payment, and operational feasibility.

B/S/C may decline, cancel, or revise an international order where shipping, customs, import, payment, insurance, legal, or delivery conditions are not suitable.

International buyers are responsible for ensuring that purchased items can be lawfully imported into the destination country. B/S/C is not responsible for customs delays, import restrictions, rejected imports, unpaid duties, taxes, brokerage fees, carrier clearance delays, seizures, or destination-country requirements unless required by law or expressly agreed in writing.

11. Site Use

You may use the B/S/C site only for lawful personal or business purposes related to viewing, requesting, or purchasing B/S/C works or services.

You may not interfere with the site, attempt unauthorized access, scrape or copy the site at scale, bypass security, misuse forms, submit false information, impersonate another person, transmit malware, spam B/S/C, or use the site for fraud, abuse, or unlawful activity.

B/S/C may restrict, block, or terminate access where misuse is suspected.

12. Intellectual Property

All content on the site, including images, text, product names, artwork, object names, graphics, code, visual systems, layouts, video, design elements, product presentation, and related materials, is owned by or licensed to B/S/C unless stated otherwise.

Viewing the site or purchasing a physical item does not transfer copyright, trademark rights, design rights, image rights, reproduction rights, commercial use rights, model-training rights, minting rights, tokenization rights, or any other intellectual property rights.

You may not copy, reproduce, distribute, publish, sell, modify, mint, tokenize, train models on, commercially exploit, or otherwise use B/S/C content without written permission.

Purchase of a physical item does not grant the right to reproduce, market, or commercially exploit the related artwork, image, design, visual system, or product presentation unless B/S/C expressly grants those rights in writing.

13. Privacy and Cookies

Use of the site is also governed by the B/S/C Privacy Policy and Cookie Settings / Cookie Policy.

B/S/C may use essential site technologies for operation, security, checkout, cart, request handling, order processing, payment processing, fraud prevention, privacy preference storage, and legal compliance.

Optional analytics and advertising technologies, if enabled, may be controlled through Cookie Settings where available.

14. Third-Party Services

B/S/C may use third-party services including Shopify, Webflow, Vercel, payment processors, shipping carriers, analytics providers if configured, advertising providers if configured, email providers, and other technical or operational services.

Third-party services may have their own terms and privacy policies. B/S/C is not responsible for third-party websites, platforms, tools, or services that it does not control.

15. No Guarantee of Continuous Availability

B/S/C may update, modify, suspend, remove, archive, or discontinue any part of the site, product presentation, service, request flow, checkout flow, or item availability at any time.

B/S/C does not guarantee that the site will be uninterrupted, error-free, secure, complete, current, or always available.

16. Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED BY B/S/C IN WRITING OR REQUIRED BY LAW, THE SITE, SERVICES, PRODUCT INFORMATION, AND ITEMS OFFERED THROUGH B/S/C ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, B/S/C WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST OPPORTUNITY, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, OR RESALE LOSS ARISING FROM USE OF THE SITE, INABILITY TO USE THE SITE, PRODUCT AVAILABILITY, ORDER DELAY, SHIPPING DELAY, OR PURCHASE OF AN ITEM.

Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnity

You agree to indemnify and hold harmless B/S/C from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the site, violation of these Terms, violation of applicable law, fraud, unauthorized use of B/S/C content, or infringement of rights of another person or entity.

19. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Where permitted by law, disputes will be handled in the state or federal courts located in Los Angeles County, California.

These launch Terms do not include an arbitration agreement or class-action waiver.

20. Changes to These Terms

B/S/C may update these Terms from time to time for operational, legal, technical, or business reasons.

The updated Terms will be posted on the site with an updated "Last updated" date. Continued use of the site after updates means you accept the updated Terms.
